Abstract

The objective of the research was to determine to what extent the civil reparation fixed with a conviction sentence affects the compliance of payment in the crime of rape of a minor. The level of research was explanatory, the applied type of research was non-experimental design, working with a sample of 55 lawyers who review convictions that have been confirmed by the Superior Court, regarding the crimes of rape issued by criminal judges of the Superior Court of Justice of the district of Huanuco, between the years 2019-2020. A questionnaire validated by expert judges in the area was applied, with a reliability of 0.801, according to Cronbach’s alpha. The results show that the effectiveness of the Civil Redress fixed is only 7.72%, finding a significance level of p = 0.000< 0.05, so the null hypothesis is rejected and the alternative hypothesis is accepted. It is concluded that the Civil Reparation fixed with conviction affects the compliance of payment in the crime of Sexual Rape of the minor in the judicial district of Huánuco in the period 2019-2020.
